     1. Introduction

    • This page (together with the documents referred to on it) tells you the terms and conditions which apply to use of the Event Delivery Booking Platform via Voyage Control.
    • Please read these terms and conditions carefully and make sure you understand them, before making a booking through the Event Delivery Booking Platform.
    • By using the Event Delivery Booking Platform, you agree to be bound by these terms and conditions. If you refuse to accept them, you will not be able to use the booking system and this could lead to delays on site and access being denied.

      2. Definitions

    • In these terms and conditions;
      • “Event Delivery Booking Platform” means the system allowing contractors and exhibitors to pre-book deliveries to the NEC site, accessed via Voyage Control and used by us on event build up days
      • “Deposit System Day” is a day designated as such as part of the booking journey. These are normally the last one or two days of build up on busier events. A Deposit System Delivery is selected as part of the booking journey and overstay charges are automatically apply on these dates where deliveries overstay there allocated unloading times.
      • “Lorry Park” means any designated lorry park operated by us on the NEC site,
      • “Pass” means the delivery pass issued via email link to individuals who pre-book deliveries
      • “Us”, “We” and “Ours” means the National Exhibition Centre Limited, a company registered in England and Wales under company number 979395 and with its registered office at The NEC Birmingham, B40 1NT. Our Vat no is 670311663.
      • “Voyage Control” means the Voyage Control website at http://voyagecontrol.com/necbirmingham and the Voyage Control app (available via Google Play and the AppStore).
      • “You”, “Your” and “Customer” means a person who has entered into a contract for access to deliver to an event on a designated deposit system day. All customers entering into a contract with us to make a delivery by booking online, will be considered to do so on behalf of themselves and all other persons whom they hold themselves out as representing.

       3. About You

    • By making a booking to deliver though the Event Delivery Booking Platform you warrant that;
      • you are legally capable of entering into a binding contract;
      • you are at least 18 years of age;
      • you have the consent of any individuals whose personal data you are inputting into the Event Delivery Platform; and
      • when adding your card details via the Stripe wireframe, you agree to Stripe (our payment services provider) being a data controller of your personal data and you accept Stripe’s privacy policy.

      4. Booking Process

    • At the time of booking you will confirm the size of vehicle being used to deliver and you will be allocated an unloading period of time.
    • At the time of the booking a credit or debit card will be required to register but charges will not be debited from your account unless the unloading time is exceeded in which case clause 5 shall apply.
    • Where you make a booking to deliver through the Event Delivery Booking Platform, a booking confirmation shall be sent by email (“Booking Confirmation”) upon acceptance of that booking, and this will include your Pass. If you do not receive an email within 24 hours, please contact Voyage Control’s support team.
    • You are required to print your Pass and bring it with you on the date of your booking.
    • On arrival at the site the driver of the vehicle will be required to report to the Lorry Park identified on the Pass. The Pass will be verified and once space is available at the hall the vehicle will be released from the Lorry Park to the halls. At this point the vehicle will be electronically “checked in” and the unloading time will commence.
    • As soon as unloading is complete the vehicle needs to leave the inner area and exit via one of the gate houses as identified on the site map (available on request). On leaving the inner area ANPR cameras will capture the departure time.
    • Bookings are non-transferable and are only valid for the vehicle and the specific dates for which they are issued.
    • The booking you make is valid only for the dates specified in the Booking Confirmation.
    • Where you make a booking the following additional terms and conditions apply;
      • you must present your Pass when you enter the Lorry Park. If you fail to do so you may be refused entry or use the on the day process which will lead to delays or admission being refused; and
      • you must display your Pass in the windscreen of your vehicle at all times when on the NEC site. Failure to do so could result in penalty charges or removal of the vehicles

      5. Overstay Charges

    • If the vehicle has exceeded the permitted unloading time a charge of £100 will be transacted and payment will be taken from the payment card used for your original booking. Overstay charges apply on all normal build up and open days, if a vehicle has exceeded its unloading time and removal has been requested but not actioned. Overstay charges are applied automatically for all deliveries exceeding their unloading time on “Deposit System Days”. Overstay charges are normally processed within 14 days of the delivery date.
    • If you experience problems at the hall that are out of your control and that prevent you from unloading within your allocated time, you must bring this to the immediate attention of an NEC security officer/traffic officer who will contact a traffic supervisor. Due consideration will then be given to the circumstances and an extension may be granted. This can only be done on the day and at the time and cannot be done retrospectively.
    • Should an overstay payment transaction fail, an electronic invoice will be sent requesting payment within 28 days. If the payment is not made within the specified time, the charge will increase to £120 and trigger debt recovery proceedings. If debt recovery proceedings are commenced additional charges will apply. Failure to pay an overstay charge may result in future bookings being blocked and a site ban being issued.

      6. Cancellation & Changing Bookings

    • Should you wish to cancel or amend your booking or part of it you may do so via the Event Delivery Booking Platform.
    • If a refund is due, it will only be made where you can provide us with a copy of your Booking Confirmation. Refunds are only made to the original card on which payment was made.
    • We reserve the right to cancel your booking. No refunds will be made other than as expressly provided for in these terms and conditions.

      7. Our Liabilities

    • Nothing in the Agreement shall limit or exclude the our liability for:
    • Subject to clause 6.1, we shall not be liable to the you, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Agreement for:
    • Subject to clause 6..1, our total liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Agreement shall be limited to the deposit fee.
  • death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors;
  • fraud or fraudulent misrepresentation; or
  • any other liability which cannot be limited or excluded by applicable law.
  • loss of profits;
  • loss of sales or business;
  • loss of agreements or contracts;
  • loss of anticipated savings;
  • loss of use or corruption of software, data or information;
  • loss of damage to goodwill; and
  • any indirect or consequential loss.

      8. Security on Site

    • You must ensure before leaving your vehicle that:
    • The public car parks, Lorry Parks and unloading areas are open to everyone. We cannot guarantee that people will not enter into the site and cause damage to property or engage in criminal behaviour. Accordingly, you enter the NEC site at your own risk. We do not guarantee the security of your vehicle and/or its contents.
    • You shall comply with all reasonable directions, regulations and instructions given by us, our servants and/or employees from time to time whilst on the NEC site.
    • Vehicles may be subject to security checks on entering the site. If you fail to submit to these checks we may refuse you and your vehicle access to the NEC site.
    • We reserve the right to move vehicles within the NEC site using whatever method we consider appropriate to such extent as is reasonably necessary for the purposes of safety to persons or property and to avoid obstruction.
  • wherever possible, all loose items and personal possessions are removed from the vehicle,
  • the vehicle is securely locked; and
  • if the vehicle has any anti-theft devices fitted they have been engaged.

       9. CCTV

    • ANPR cameras may be used to identify your vehicle when it arrives and leaves the site and areas within the site. This information is used for statistical analysis purposes and to verify time and date of arrival and departure. We reserve the right to use this footage to recover parking charges from you should you leave the site having overstayed your delivery time.
    • CCTV cameras are installed on the NEC site and are used to assist in the proper running of the site. The CCTV cameras may also act as a deterrent to criminal activity. We are obliged by law to display signage advising that CCTV cameras are in operation. However, we do not make any representations as to the extent of coverage provided by the cameras and no guarantee is given as to the security of your vehicle in the site where CCTV is installed.

        10. General

    • Each of these terms and conditions shall be construed separately, applying and surviving if for any reason other provisions are held inapplicable or unenforceable in any circumstances.
    • Nothing in these terms and conditions shall take away or modify any of your statutory rights or entitlements.
    • These terms and conditions are governed by and shall be construed in accordance with English Law and any claims arising under them are subject to the exclusive jurisdiction of the English Courts.
    • If any provisions of the terms and conditions (or any part of any provision) is found to by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of these terms and conditions, and the validity and enforceability of all other provisions of this agreement shall not be affected.
    • If a provision of these terms and conditions (or part of any provision) is found illegal, invalid or unenforceable, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.
    • These terms may be amended by us at any time on giving 30 days’ written notice to you. If you do not agree to any such amendments, you shall have the right to terminate the Agreement with immediate effect.
    • No provision in these terms is intended or does it confer upon any third party, any benefit or right enforceable by third party.
